TechnicalSupport4u Terms and Conditions of Use

1. NOTICE

1.1 These terms and conditions (the "Terms of Use" or this "Agreement") set out the agreement between you (the Customer of TechnicalSupport4u) and TechnicalSupport4u Limited under which we will provide you with Personal Computer (PC) technical support services. It is in your interest to read these terms and conditions.

1.2 In this agreement the term "Services" will mean TechnicalSupport4u technical support services delivered through a premium rate telephone line. Unless otherwise stated, Services shall be provided to you by TechnicalSupport4u Limited, a company registered in England and Wales (company number 4693984), whose registered office is located at 125a London Road, Waterlooville, Hants, PO7 7DZ

2.0 ACCEPTANCE OF TERMS THROUGH USE

2.1 By using the Services, you signify your agreement to all terms, conditions, and notices contained or referenced herein (the "Terms of Use"). If you do not agree to these Terms of Use, please do not use the Services. We reserve the right, at our discretion, to update or revise these Terms of Use. Please check these Terms periodically for changes. Your continued use of the Services following the posting of any changes to the Terms and Conditions of Use constitutes acceptance of those changes.

3.0 LIMITATION OF THE SERVICES

3.1 We endeavour to make all reasonable efforts to diagnose your PC related technical problem and provide you technical assistance for third-party products and third party services that we support detailed at our website www.pchelplines.co.uk. There is no guarantee that we will be able to solve the reported issue. Some issues may not be resolvable during one or more phone calls.

3.2 We may suspend the Services where necessary for operational reasons such as repair, maintenance or improvement of the Services or because of an emergency. Except in the event of an emergency, we will try to give you as much notice as possible of any periods of downtime of the Services by posting a notice at our website www.technicalsupport4u.com or by any other reasonable means. We will endeavour to restore the Services after suspension as soon as is reasonably possible.

3.3 We may, for operational or other reasons, change any of the support line numbers or the specification of the Services. Any such changes will not materially affect the Technical Support Services you receive from us.

3.4 You should note that various elements of the Services are not provided by us, but iby other companies. We are therefore unable to guarantee that such products and services or any websites recommended to you via the Services are virus or error free. You should check all e-mails, attachments or files before downloading them.

3.5 You acknowledge that licensed telephone operators provide the telephone networks which are utilised by us, and therefore we cannot guarantee that the Services will be uninterrupted or error free.

4.0 YOUR USE OF THE SERVICES

4.1 As a customer of TechnicalSupport4u you warrant that you are at least 18 years of age and possess the legal authority to enter into this agreement. You agree to be financially responsible for all of your use of this Service (as well as for the use of this service by others, including, without limitation, minors under 18 years old living with you).

4.2 We may recommend to you, in the course of providing technical advice, third-party software that will help remedy your technical PC problem. In such cases you agree to abide by the terms and conditions, copyright and licensing terms governing the use of the third-party software as set out by the software provider or its distributor.

4.3 We may accept instructions in connection with the Services from someone we are satisfied has your authority and you agree that you will be responsible for all use and resulting consequences of use of the Services whether or not authorised by you.

5.0 PERSONAL DATA

5.1 We will comply with the Data Protection Act 1998 and other any applicable data protection legislation.

5.2 By personal data we mean any data that identifies or relates to you. It includes identity information, which you agree to supply to us accurately, and to keep up-to-date. It also includes recordings of calls you make to the service.

5.3 When you call our Services, we will monitor and record your calls and store details of the phone number(s) from which you make the call. This information is used only to track-reported problems, and better address your customer service needs.

5.4 We reserve the right to forward your contact details to the police, or other regulatory or government authorities where properly requested to do so. We may also forward contact details where a complaint arises concerning your use of the Services and where that use is deemed by us to be inconsistent with these Terms and Conditions of Use.

6.0 CHARGES AND BILLING

6.1 You will be charged for using the Service(s) in accordance with help-line you select, (and its associated per minute rate), that you deem best meets your needs. The rates applicable for each Service are advertised with the all our hel- line numbers. All prices for the Services are shown in British Pounds & Pence (GBP) and are charged per minute (or part thereof) when your call is connected with a TechnicalSupport4u advisor. Per minute charges are inclusive of VAT.

6.2 Any use of the Services will be charged directly to your telephone bill and prices for the Service(s) are subject to change without notice. You should let us know about any billing problems or discrepancies promptly after they first appear on your telephone bill. If you do not bring them to our attention within 30 days, you will have waived your right to dispute those problems or discrepancies.

7.0 COMPLAINTS PROCEDURE

If at any time you feel you have cause to complain about our Services, we will be pleased to hear from you. Please contact us in writing at the following address.

We will endeavour to acknowledge your complaint within 7 working days. Your complaint will be dealt with speedily and efficiently, and we will inform you of the steps we intend to take to remedy the situation and, where necessary, to update procedures to ensure that the problem does not occur again.

8.0 WARRANTY AND LIABILITY

8.1 You agree that by using the Services supplied to you, it is done so at your sole risk. TechnicalSupport4u disclaims any and all warranties, either expressed or implied. In no event shall TechnicalSupport4u be liable to you or any third party for any damages, consequential or inconsequential loss whatsoever, (including, without limitation, damages for loss of business revenues or profits, business interruption, loss of business or personal information or any other monetary loss) arising out of the use or inability to use information or assistance given as part of the Services, even if that loss or damage was foreseeable or TechnicalSupport4u has advised of the possibility of such losses or damages.

8.2 Without limiting paragraph 8.1 (and except for any liability which may not by law be limited), the liability of TechnicalSupport4u under this Agreement (whether arising in negligence or otherwise) will not under any circumstances exceed an amount equal to the fees owed to TechnicalSupport4u by you during the 30 day period preceding the time liability arises, regardless of the cause or form of action.

8.3 You may need to make some modifications to your PC, PC Server or PC Networks to resolve an issue or assist you in your request as part of the Services, it is your responsibility to ensure that such modifications do not invalidate the terms of any warranty or contracts you may have in relation to the PC, PC Server or Networks. We shall have no liability for any claim that your warranty has been invalidated, or a contract breached as a result of work carried out by you, on the advice of our advisors in order to make your PC operate.

8.4 We are not liable for any failure to perform our obligations if we are prevented from doing so by an event beyond our reasonable control (which may include, without limitation, strikes; labour disputes; acts of God; war; riot; civil action; malicious acts or damage; compliance with any law, governmental or regulatory order, rule, regulation or direction; any act or omission of any government or other competent authority; accident; equipment or services failure, including the unavailability of third party telecommunications services, lines, or other equipment; fire; flood or storm).

8.5 Upon request by TechnicalSupport4u, you agree to indemnify TechnicalSupport4u and its respective subsidiaries and affiliates, their employees, contractors, officers, directors, telecommunications providers and content providers from all liabilities, claims and expenses that arise from any breach of this Agreement.

8.6 TechnicalSupport4u reserves the right, at its own expense, to assume the exclusive defence and control of any claim which is subject to indemnification by you under this Agreement, in which event you will (from that time onwards) have no further obligation to provide indemnification for that claim.

9.0 MISCELLANEOUS

9.1 You may not transfer this Agreement or any part of it to anyone else. We may transfer the benefit and burden of this Agreement to any person taking over the supply of the Services or any part of the Services without your prior consent by giving you notice. We may also sub-contract or assign the provision of the Services or any part of the Services to any other person.

9.2 If any part of this Agreement is found to be illegal or unenforceable, this will not affect the validity and enforceability of the remainder of the Agreement.

9.3 If either we or you delay or fail to enforce any right under this Agreement that will not be deemed to be a waiver of that right, and will not prevent that right or any other right or remedy from being exercised or enforced.

9.4 This Agreement constitutes the entire agreement between us relating to the provision of the Services and supersedes any previous agreements and understandings between us relating to the Services (except that we do not limit or exclude our liability to you in respect of any fraudulent misrepresentations).

9.5 Nothing in this Agreement is intended to create any rights under the Contracts (Rights of Third Parties) Act 1999, which is enforceable, by any person who is not a party to this Agreement. Nothing in this Agreement shall affect any right or remedy of a third-party which exists or is available other than as a result of the aforementioned Act.

9.6 The Terms of this Agreement do not affect your statutory rights as a consumer.

9.7 The provision of the Services and the application of this Agreement are governed by English Law and the parties hereby agree to submit to the exclusive jurisdiction of the English Courts in respect of any dispute or matter arising out of or in connection with this Agreement.
